1. Introduction

These Terms and Conditions ("Terms") govern access to and use of the website nocturnecarajillo.com (the "Site"), operated by NOCTURNE Carajillo ("NOCTURNE", "we", "our"), domiciled in Panama City, Republic of Panama.

By accessing and using this Site, you agree to be bound by these Terms, our Privacy Policy and all applicable laws and regulations, including Panama's Ley 51 de 22 de julio de 2008 (Electronic Commerce Law). If you do not agree with any of these Terms, do not use the Site.

3. Age Requirement

NOCTURNE Carajillo is an alcoholic beverage. Under Panamanian law, the sale and supply of alcoholic beverages to persons under 18 years of age is prohibited. By accessing this Site, you confirm that you are at least 18 years old or the minimum legal drinking age in your jurisdiction, whichever is higher.

We reserve the right to request age verification at any time and to deny access to any person who does not meet this requirement.

All content on the Site, including but not limited to text, graphics, logos, images, design, trademarks and source code, is the property of NOCTURNE Carajillo or its licensors and is protected by Panama's Ley 35 de 10 de mayo de 1996 (Industrial Property Law) and other applicable intellectual property legislation of the Republic of Panama, as well as international treaties.

Reproduction, distribution, modification, public display or any other use of Site content without prior written authorisation from NOCTURNE is prohibited.

5. User Content

Any information you submit through the Site, including contact form data, will be treated in accordance with our Privacy Policy. By submitting information, you warrant that you have the right to share it and that its content is not illegal, defamatory or infringing upon the rights of third parties.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Panama, including:

  • Ley 45 de 31 de octubre de 2007 (Consumer Protection and Competition Law) and its Decreto Ejecutivo 46 de 2009
  • Ley 51 de 22 de julio de 2008 (Electronic Commerce Law)
  • Ley 81 de 26 de marzo de 2019 (Personal Data Protection Law)

Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Panama City, Republic of Panama.
